Privacy Policy

ADPOS is committed to protecting the privacy and security of all Personal Data processed as part of its business activities.
The purpose of this Privacy Policy is to explain what Personal Data ADPOS collects about You and how ADPOS processes it. This Privacy Policy also explains Your rights, so please read it carefully. If You have any questions, You can contact ADPOS using the information provided below.
ADPOS”, “we”, “our” or “us” means the ADPOS entity responsible for the collection and use of Personal Data under this Privacy Policy.
Personal Data” shall has the same meaning as defined in the Terms of Use, which means any information relating to a data subject, defined herein as an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
Platform” or “Sites” shall has the same meaning as defined in the Terms of Use, which means ADPOS Virtual Credit Card Management Platform located at www.adpos.io and operated by ADPOS.
Service” shall has the same meaning as defined in the Terms of Use, which means the the ADPOS Virtual Credit Card Management Service provided by ADPOS.
Transaction Data” includes Personal Data, and may include the following: Cards number, merchant and location, purchase amount, date of purchase, and in some cases, some information about what you have purchased. All the Transaction Data is acquired from Cards issuer through API.
You” means end user, Authorized Users as defined in the Terms of Use or visitor: All capitalized terms not defined herein shall have the same meaning construed in the Terms of Use.

1.  Personal Data that we collect and how we use and share it
1.1.  Personal Data that we collect about You
As You navigate through the Sites and register yourself as a user of the Service and the Platform, some of your Personal Data may be actively collected (for example, name, nickname, e-mail address, company name, personal ID card number, address, telephone number, Telegram number, Skype number, bank account information (if You register yourself as an individual) and related information) or passively collected (which you did not actively provide) such as your browser type, domain name, IP address, pages visited, and the length of your user session using various technologies and means, such as Internet Protocol Address, cookies, Internet Tags and navigational data collection. Meanwhile, we also collect Transaction Data generated during your use of the Service and the Platform through API from third party Cards issuers, such as Card number, user name, merchant name and billing amount. In order to improve the Service and the Platform, it may be necessary to ask for Personal Data to fulfill your requests and provide a better service. ADPOS is entitled to take measures to validate the authenticity of Personal Data provided by You or third party Cards issuers. If You provide us with Personal Data of somebody else, we will assume that You have their permission to do so.
1.2.  How we use and share Personal Data
The provision of personal information by you may be necessary where in our legitimate interest for the following purposes: (i) to provide You with the Service and enable You to access the Platform; (ii) to perform ADPOS’ obligations and enforce its rights under the TOU; (iii) to operate and improve the Service and Platform; (iv) to detect frauds and abnormal and unauthorized login; and (v) for analytics and general reporting or research purposes, notably as part of the Service and Service enhancement.
We do not sell or share any Personal Data with third parties for marketing or advertising their products without your separate consent.
We may use selected third parties to provide us with services, including companies that assist with programming and technical aspects of hosting and operating the Platform and the Sites, who may have access to your Personal Data. Our affiliates may also have access to your Personal Data including through or in connection with the Sites for the purposes set out in this Privacy Policy. The servers used in the operation of the Platform and the Sites automatically identify a computer by its IP address. Although, we will not be able to identify the computer using its IP address once You have left the Platform and the Sites. If we, in good faith, determine that You have or are attempting to misuse or harm the Platform and the Sites, we may investigate and cooperate with appropriate law enforcement agencies to protect our rights or property. Similarly, we may share your Personal Data as required or permitted by law to comply with a subpoena or similar legal process or government request, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our rights and property, or the rights, property or safety of others, including to advisers, law enforcement agencies, judicial and regulatory authorities. We may also transfer your Personal Data to a third party that acquires all or part of our assets or shares, or that succeeds us in carrying on all or a part of our business, whether by merger, acquisition, reorganisation or otherwise.
2.  Legal bases for processing Personal Data
For the purposes of the General Data Protection Regulation, we rely upon a number of legal bases to enable our processing of your Personal Data. For more information, see here.
a.  Contractual relationships.
a)   We process Personal Data for the purpose of entering into business relationships with prospective users and to perform the contractual obligations with the users. Scenarios include:
b)   Creation and management of ADPOS Account and ADPOS Account credentials, including the evaluation of applications to commence or expand the use of our Service;
c)   Accounting, auditing, and billing activities; and
d)   Processing of deposits, including fraud detection, loss prevention, optimizing valid transactions, communications regarding such payments, and related support service.
b.  Legal compliance.
We process Personal Data to verify the identity of individuals and entities in order to comply with fraud monitoring, prevention and detection obligations, laws associated with the identification and reporting of illegal and illicit activity, such as "Anti-Money Laundering ("AML") and Know-Your-Customer ("KYC") obligations, and financial reporting obligations.
c.  Legitimate interests.
Where it is permissible under applicable law, we rely on our legitimate business interests to process Personal Data about You. The following list sets out the business purposes for which we have a legitimate interest in processing your Personal Data:
a)   Detect, monitor and prevent fraud and banned transactions;
b)   Mitigate financial loss, claims, liabilities or other harm to You, Authorized Users and ADPOS;
c)   Respond to inquiries, send Service notices and provide customer support;
d)   Promote, analyze, modify and improve the Service, the Platform and the Sites and develop new products and services;
e)   Manage, operate and improve the performance of our Sites and Services by understanding their effectiveness and optimizing our digital assets;
f)   Conduct aggregate analysis and develop business intelligence that enable us to operate, protect, make informed decisions, and report on the performance of, the Service;
g)   Share Personal Data with third party service providers that provide services which help us operate and improve the Service and the Platform;
h)   Share Personal Data among our affiliates.
d.  Consent.
ADPOS may rely on consent to collect and process Personal Data as it relates to how we communicate with You and for the provision of our Service. When we process Personal Data based on your consent, You have the right to withdraw your consent at any time without affecting the lawfulness of processing based on such consent before the consent is withdrawn.
3.  Disclosure of Personal Data
ADPOS may use selected third parties service provider to provide services, including companies that assist with programming and technical aspects of hosting and operating the Sites, who may have access to your Personal Data. Our affiliates may also have access to your Personal Data including through or in connection with this Sites for the purposes set out in this Privacy Policy. 4.  Your Rights
If You are in the EEA, You have a right to (subject to a limited number of exceptions): (i) request access to and rectification or erasure of your Personal Data; (ii) obtain restriction of processing or to object to processing of your Personal Data; and (iii) ask for a copy of your Personal Data to be provided to them, or a third party, in a digital format. You also have the right to lodge a complaint about the processing of your Personal Data with your local data protection authority in the EEA.
If You are residents of the State of California in the United States, effective from January 1, 2020, You can request the following information about how we have collected and used your Personal Data during the past 12 months:
a.   The categories of Personal Data we have collected.
b.   The categories of sources from which we collected the Personal Data.
c.   The business or commercial purpose for collecting and/or selling Personal Data.
d.   The categories of third parties with whom we share the Personal Data.
e.   The categories of Personal Data that we sold or disclosed for a business purpose.
f.   The categories of third parties to whom the Personal Data was sold or disclosed for a business purpose.
g.   Access. You can request a copy of the Personal Data that we have collected about You during the past 12 months.
h.   You can ask us to delete the Personal Data that we have collected from You.
You are entitled to exercise the rights described above free from discrimination as prohibited by the CPRA. You may submit requests to exercise your California privacy rights described above by writing to us at: privacy@adpos.io and (ii) opt out of selling of your data by clicking on the following link: DO NOT SELL MY DATA . You can provide opt-in consent for sale of personal information about them by writing email email to us at privacy@adpos.io.
These rights are not absolute, and in some instances, we may decline your request as permitted by law. We will need to verify your identity to process your information, access, and deletion requests and reserve the right to confirm your California residency.
5.  Security and retention
ADPOS make reasonable efforts to provide a level of security appropriate to the risk associated with the processing of your Personal Data. ADPOS maintains organizational, technical and administrative measures designed to protect Personal Data covered by this Privacy Policy against unauthorized access, destruction, loss, alteration or misuse.
To help us protect Personal Data, where You have an ADPOS Account, we encourage You to use a strong password, protect that password from unauthorized use and not use the same log-in credentials (e.g. password) for your ADPOS Account as You do with other services or accounts.
We retain your Personal Data as long as we are providing the Service to You or our or for a period during which we reasonably anticipate providing the Service. Even after we stop providing Service to You, and even if You close your ADPOS Account, we may retain your Personal Data for no longer than one year thereafter for the following purposes:
a.   to comply with our legal and regulatory obligations.
b.   to enable fraud monitoring, detection and loss prevention activities.
c.   to comply with our tax, accounting, and financial reporting obligations.
6.  International data transfers
When You are located in the EEA, Personal Data collected from You, including via the Sites, will be transferred to recipients in countries located outside the EEA (including in Singapore where the Sites is hosted) which do not provide a similar or adequate level of protection to that provided by countries in the EEA. You hereby expressly consent to the transfer of your Personal Data to recipients, as described in this Privacy Policy, which are located outside the EEA. ADPOS has entered into EU standard contractual clauses (“Model Contracts”) for intra-group transfers of Personal Data to its affiliates. You can request a copy of these Model Contracts by submitting your request via email to privacy@adpos.io.
7.  Protection of Minors
The Service and the Platform are not for minors under 18 years of age or user is deemed as minor under applicable law. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should promptly contact us and we take reasonable steps to ensure that such information is deleted from our files.
8.  Marketing
We may contact You periodically by e-mail to provide information regarding our service and product that may be of interest to You. If applicable law requires that we receive your consent before we send You certain types of marketing communications, we will only send you those types of communications after receiving your consent. If You decide at any time that You no longer wish to receive such communications from us, You may follow the unsubscribe instructions provided in any of the communications or request to be opted-out of receiving such communications via email to privacy@adpos.io.
9.  Cookies
ADPOS may use cookies, or other technology (collectively “Cookies”) to collect certain information about You when You are visiting the Sites. Cookies is a small text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. The purpose of Cookies is to provide a convenience feature to save your time. By using the Sites, You consent to the use of these Cookies. If You do not accept these Cookies, You can change your browser’s settings to delete cookies that have already been set and to not accept new Cookies. Please however note, that, if You delete Cookies or do not accept them, You might not be able to use all of the features we offer, You may not be able to store your preferences, and some of our pages might not display properly. 10.  Updates and notifications
We may change this Privacy Policy from time to time to reflect new services, changes in our privacy practices or relevant laws. The “Last updated” legend at the top of this Privacy Policy indicates when this Privacy Policy was last revised. Any changes are effective the latter of when we post the revised Privacy Policy on the Sites or otherwise provide notice of the update as required by law.
